SEQUOYAH COUNTY, Okla. — A man in Oklahoma has been sentenced to 25 years in prison for assault and putting a child in danger during an assault, according to a release from The United States Attorney’s Office for the Eastern District of Oklahoma (USAO).
The release says on Oct. 8, 2022, when officials responded to a 911 call, about 25-year-old Elbert Andrew Fuller shooting at a family member. When police arrived, they found Fuller "leaving a residence" while carrying a baby. The release said Fuller fired a pistol "multiple times at the officers," before dropping the gun and pulling out a knife. USAO states Fuller tried to stab one of the officers, all while holding the baby. Eventually, a family member was able to safely take the baby from Fuller.
Officials said Fuller was eventually "subdued and taken into custody."
On June 22, 2023, Fuller pleaded guilty to the following charges:
- 1 count of assault with intent to commit murder in Indian Country
- 1count of child abuse in Indian Country
- 1 count of child neglect in Indian Country
- 3 counts of assault with a dangerous weapon with intent to do bodily harm in Indian Country
- 1 count of use, carry, brandish, or discharge of a firearm during and in relation to a crime of violence
According to the release, this took place in Sequoyah County "within boundaries of the Cherokee Nation Reservation." This led to an investigation with the FBI, Roland Police Department, Cherokee Nation Marshal Service and the Sequoyah County Sheriff's Office. All counts were ordered to run concurrently, totaling 308 months in prison.
“The defendant’s violent acts endangered multiple people, including a child, and the sentence imposed is certainly fitting punishment,” said United States Attorney Christopher J. Wilson.
