Arkansas AG files lawsuit against NWA construction company

The lawsuit states that Ground Zero Construction Inc. refused to comply with Arkansas law by failing to call the One Call Center, 811, before they dig.

ARKANSAS, USA — Arkansas Attorney General Tim Griffin has filed a lawsuit against a Northwest Arkansas excavation company and its owner, Rod Garman. 

According to a statement released by AG Griffin, Ground Zero Construction Inc. is accused of repeatedly damaging natural gas lines by refusing to comply with the Arkansas Underground Facilities Damage Prevention Act.

The act requires excavators to call the One Call Center, commonly known as 811, before they excavate. 

It also prohibits using mechanized equipment without express approval near underground facilities and is intended to limit damage to natural gas lines and other underground facilities and protect the public from harm, explained AG Griffin.

“By refusing to comply with 811 requirements before excavating, Ground Zero has repeatedly put the public at danger. Its failure to abide by the law is an unconscionable business practice pursuant to the Arkansas Deceptive Trade Practices Act."

AG Griffin further explained that all businesses should dig safely by complying with the excavation law and calling 811.
